1. The Service Provider and scope of the Terms
The service is provided by Pethő Travel Személyszállító Kft. (Service Provider). Registered office: 4501 Kemecse, Móricz Zsigmond u. 76., Hungary; company registration number: 15-09-085413; tax number: 25977574-2-15. Registration court: Nyíregyházi Törvényszék Cégbírósága (Company Court of the Nyíregyháza Regional Court). Business premises: 4400 Nyíregyháza, Kinizsi Pál utca 9/b., Hungary. Contact: +36 30 488 2729; iroda@pethotravel.com; info@pethotravel.com. Website: https://pethotravel.com.
The Kft. is the Customer's contracting party and is responsible for passenger transport. It does not merely act as an intermediary for another provider's service. It may engage a subcontractor to perform the service and is liable for the subcontractor's conduct as if it had acted itself.
These Terms apply to contracts for pre-booked passenger transport concluded with the Service Provider on the domestic and international routes it undertakes. The Customer is the natural or legal person entering into the contract; the passenger is the person actually travelling. A consumer is a natural person acting outside their trade, independent profession or business activity. The name of the service category does not in itself determine consumer status. The external Fleet software subscription is a separate product and is not covered by these Terms.
2. Orders, offers and acceptance
The Customer may submit their travel requirements through the website, by email or by telephone. They must specify the planned journey, date and time, pickup and arrival locations, number of passengers, contact details and any special requirements. They may check and correct the information before acceptance.
The offer specifies the journey, its price, the offer's validity, the payment and cancellation terms, and the consequence of acceptance as disclosed in advance. The contract is formed when the Customer accepts a valid offer. A technical message acknowledging receipt of a mere request for an offer does not finalise the service.
The Customer may review the Terms and the privacy notice before acceptance. The Service Provider acknowledges receipt of acceptance of the offer electronically without delay. The accepted versions of the offer and the Terms, together with evidence of acceptance, must be retained; later website changes do not alter the accepted content. For corporate or partner orders, the terms referred to in the separate agreement must also be taken into account.
3. Performance and cooperation
The Service Provider must perform the journey and service undertaken in the accepted offer. The Customer is responsible for accurate travel and contact information and must report changes without delay. The passenger must be ready to travel at the agreed pickup location and time. Changes to the service require agreement; the parties must settle their content and financial consequences before making the change.
Any transport requirements beyond normal luggage, or other special transport requirements, must be notified in advance. A child seat must be requested when booking; a seat meeting the requirements notified in advance must be provided. Failure to give advance notice cannot override mandatory child safety rules. Accessible accommodation in the vehicle must be agreed in advance, as it cannot be provided in every vehicle.
4. Price, payment and invoicing
Before acceptance, the offer states the total amount payable in Hungarian forints (HUF), the tax treatment and any known separate charges. The payment method, deadline and any advance payment are specified in the individual offer or a separate agreement. A general exemption from VAT based on the supplier's status cannot be assumed for all prices; the tax treatment stated in the individual offer applies.
The legal entity issuing the invoice is selected at the time of invoicing. This does not change the Kft.'s role as contracting party, the accepted total amount or the tax treatment. An invoice may not be issued by an entity incompatible with these.
The accepted price may not be increased unilaterally. Later changes to the website price list do not affect an offer already accepted. Additional services or other changes may alter the price only on terms disclosed in advance and mutually agreed. This does not exclude the statutory consequences of the Service Provider's delay or defective performance.
5. Cancellation and no-show
The rules specified in Section 3 of the 45/2014. (II. 26.) Korm. rendelet (Hungarian Government Decree) apply to the passenger transport contract; the Customer does not have the general 14-day right to withdraw without giving reasons that otherwise applies to distance contracts. Contractual cancellation under these Terms is a separate right. The cancellation charge is a payment for exercising the contractual cancellation right (bánatpénz), not a contractual penalty (kötbér).
| Receipt relative to departure / event | Cancellation payment (bánatpénz) |
|---|---|
| At least 48 hours before departure | 0% |
| Less than 48 hours, but at least 24 hours before departure | 50% |
| Less than 24 hours before departure or no-show | 100% |
This table applies only to the contract of a Customer who accepts the new terms version containing it. For an earlier acceptance, the table in the terms actually accepted remains applicable.
The charge is based on the accepted price of the cancelled service or affected part. Cancelling one direction of a return journey is a partial cancellation. A reduction in passenger numbers does not automatically move the booking to a cheaper tariff; the conditions of the original band remain applicable. The proposed percentage charge and any discretionary waiver are separate decisions. The cancellation payment is justified by the vehicle, driver and organisational capacity reserved; the consumer's mandatory rights and the possibility of judicial reduction of an excessive cancellation payment remain unaffected.
Cancellation may be notified to iroda@pethotravel.com or info@pethotravel.com, or by telephone on +36 30 488 2729. The communication must identify the journey or booking, its date and time, and whether the cancellation is full or partial. Cancellation takes effect on receipt, not when the Service Provider acknowledges it. An unclear communication requires clarification; the original receipt is also retained.
The Service Provider issues an immediate, time-stamped acknowledgement of receipt identifying the affected journey or part, the receipt time in the Europe/Budapest time zone and, if already available, the proposed charge. The proposal is neither an invoice nor an automatically determined final claim. The Customer may report errors in the time or information communicated; silence does not constitute indisputable acceptance.
A no-show is established on the basis of documented circumstances. The driver must arrive at the location, wait at least 30 minutes and attempt at least two documented telephone calls; contact through other channels does not replace these calls. Doubt or insufficient evidence requires an office review, rather than automatic enforcement of a charge. A waiting charge and a no-show charge have different legal bases.
In the event of documented force majeure or other circumstances warranting consideration, the office decides on a waiver based on the circumstances. If the service fails for reasons attributable to the Service Provider, the amount paid for the unperformed service must be refunded. There is no automatic compensation under a reversed percentage table; the Customer's statutory claims remain unaffected.
6. Liability
The Service Provider is liable for a subcontractor involved in performance as if the subcontractor's conduct were its own. Liability for intentional breach of contract or for breach causing harm to life, physical integrity or health may not be excluded or limited.
The Customer specifies their requirements taking account of their flight and the time needed for travel. The Service Provider cannot guarantee external circumstances beyond the passenger's control, such as traffic or airport queues. For consumers, the statutory rules on foreseeability govern consequential financial loss; these Terms do not limit such liability merely to the fare. For a non-consumer Customer, liability for such consequential financial loss is limited to the fare for the affected journey, without prejudice to the mandatory exceptions above.
7. Complaints and remedies
Complaints may be submitted through the Service Provider's email addresses or telephone number above, or to its registered postal address. We provide a substantive written response to a written complaint within 15 working days. Passengers who are not registered are also entitled to complain.
In a consumer dispute, conciliation board proceedings may be initiated. The regional body for the Service Provider's registered office is the Hajdú-Bihar Vármegyei Békéltető Testület (Hajdú-Bihar County Conciliation Board; 4025 Debrecen, Vörösmarty u. 13–15., Hungary; bekelteto@hbkik.hu; +36 52 500 743, +36 52 500 745; https://www.bekeltetes.hu). Consumers may also contact the board for their own place of residence or stay, or another board permitted by law. The Service Provider cooperates with the conciliation board.
Claims may also be pursued before a court. No exclusive court jurisdiction is stipulated against consumers; the statutory rules apply. For a non-consumer Customer, jurisdiction is agreed in favour of the Nyíregyházi Járásbíróság (Nyíregyháza District Court) within the limits of the rules on subject-matter jurisdiction.
8. Data processing
Detailed information on data processing is provided in a separate notice: https://pethotravel.com/adatvedelmi-tajekoztato. The Customer receives the notice and warrants that they are entitled to disclose the passenger data they provide and have informed the passengers concerned about the processing. Reading the notice does not in itself constitute consent to data processing; the controller's statutory obligations remain unaffected.
Data subject requests may be sent to iroda@pethotravel.com; data protection officer: Pethő László. The response deadline is generally one month; the notice sets out the detailed procedure for exercising rights. Evidence of cancellation is processed separately, in accordance with its purpose and the approved retention rules. Different rules may apply to erasure of data needed for legal claims or mandatory retention.
9. Applicable law and versions
The contract is governed by Hungarian law, in particular the Polgári Törvénykönyv (Hungarian Civil Code). This does not deprive consumers of any mandatory protection to which they are entitled. Changes to the Terms do not unilaterally alter a contract already accepted; the version accepted by the Customer applies. The accepted content must remain retrievable.
These Terms and Conditions take effect from the date of publication.
